DMCA Policy
Grape Ice Cream respects the intellectual property rights of others and expects its users to do the same. This DMCA Policy outlines our procedures for addressing alleged copyright infringement under the Digital Millennium Copyright Act (DMCA).
Filing a DMCA Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Grape Ice Cream service, you may notify our designated copyright agent by submitting a DMCA Takedown Notice. To be effective, your notice must be a written communication that includes substantially the following:
- Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail to identify the copyrighted work, such as a URL link to the original work or a copy of the work itself.
- Identification of the material that is claimed to be infringing: Clearly identify the specific location (e.g., URL) on Grape Ice Cream's services where the material you claim is infringing is located.
- Information reasonably sufficient to permit Grape Ice Cream to contact the complaining party: This should include your full name, address, telephone number, and email address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- An electronic or physical signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you have the option to file a counter-notification. A counter-notification must be a written communication that includes substantially the following:
- Identification of the material that has been removed or to which access has been disabled: Please include the URL(s) or other specific identification of the material before its removal or access disablement.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your full name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the U.S., for any judicial district in which Grape Ice Cream may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your electronic or physical signature.
